DECISION: North Carolina Proud Boy leader Charles Donohoe is detained pending trial. Donohoe will remain in custody on the order of Judge Tim Kelly. His three co-defendants--other Proud Boy leaders Ethan Nordean, Joe Biggs & Zach Rehl--are also detained. https://t.co/e6drY88u9j
Remember this--it may prove useful in understanding a disinformation campaign that may be pending: A federal prosecutor is saying in court that NC Proud Boy Charles Donohoe *led* lower-ranking NY Proud Boy Dominic Pezzola toward the Capitol after they obtained a police shield. https://t.co/dmlAqBxL3i
JUST IN: There are now *two* J6 guilty pleas scheduled for today. One is Florida Oath Keeper Graydon Young. The other is Maryland man, Robert Reeder, who's charged with relatively minor trespass & disorderly conduct charges. Nothing yet on what their deals w/the govt entail. https://t.co/u6Q6nMg26V
Young, from Florida, played a relatively minor role in the Oath Keepers' breach of the Capitol. He reached out to the group only a month before J6 & went to DC with his sister Laura Steele. He was then part of the stack of OKs that stormed the building. https://t.co/P6Pygj7kqw
To be clear, the Oath Keeper mentioned in this tweet agreed to cooperate over two months ago. There is also no clear evidence that his testimony is the epicenter of the Oath Keeper investigation. He is not charged w/the other defendants and may have only limited knowledge of them https://t.co/pxOEVkRsQE
If all goes as planned, NC Proud Boy leader Charles Donohoe will appear in court at 10 am for a bond hearing. Judge Tim Kelly had been waiting for the DC circuit court to rule on his detention of two of Donohoe's co-defendants but seems ready to move forward with the hearing. https://t.co/4rLhZeMdz7
For those who followed the last two days of sovereign citizen Pauline Bauer's journey through a DC magistrate court, here's a glimpse of the document she filed in Penn after her arrest for breaching the Capitol. It gives a flavor of sovereign citizen language and tactics. https://t.co/RazE82SopC
FWIW, a lot of people are complaining about the deference that Magistrate Judge Faruqui showed to Pauline Bauer, who invoked sovereign citizen rights. But remember--he has to treat her as innocent and has to respect both her right to counsel and her right to defend herself. https://t.co/q6xkJvA51g
Judge Faruqui did the right thing by gently & firmly coaxing a woman who does not believe in the system to play by the rules of the system. If that deference isn't always extended to all other defendants it doesn't really seem like it's *his* fault. https://t.co/N76HSiKGpc
Judge Faruqui forgot to arraign Bauer and now he has to do it. She proclaims her innocence but refuses to enter a formal plea of not guilty and moreover (as is her right) she's making Faruqui go through the typically waived process of reading the entire indictment aloud.
Judge Faruqui did it. It took three hearings spread over two days but he got J6 sovereign citizen defendant Pauline Bauer to agree to conditions...that will set her free pretrial. (He waived the signature requirement.) So ends Ms. Bauer's "divine special appearance" in court.
Bauer is back. She turned down the services of the stand by counsel who filed the notice on her behalf. Judge Faruqui has picked up where he left off yesterday, trying to get Bauer to agree to conditions of release even if she doesn't recognize the jurisdiction of his court...
As we wait to see if Pauline Bauer, the sovereign citizen J6 rioter who was jailed yesterday for contempt after saying was making a "divine special appearance", is returning to court, her lawyer files a notice explaining what was in the 37-pager she wanted to read aloud yesterday https://t.co/Ulna47cs7R
